What Are the Elements of a Successful Estate Plan?
Last Will and Testament
Think of a will as the last gesture of affection you can offer your family, your friends, and the organizations you value. A West Valley Arizona estate planning attorney will help you craft and execute a valid will, one that can stand up against court scrutiny. Your will needs to be comprehensive because according to state law, any assets you haven’t mentioned could be excluded from probate and distribution. A lawyer also will scrutinize any of your existing wills, noting what should be changed to more accurately reflect new circumstances (such as divorce, business conflict, or changes in the family). We recommend reviewing your will every three years to keep it current.
Living Trust
A living trust is used to hold and transfer assets. You create it during your lifetime and use it to hold property for your own use, then you pass it to your heirs when you die. A living trust can protect you against claimants and creditors. This in turn means you can reserve more property for when you are retired. Trusts hold advantages to wills in certain respects, such as your heirs avoiding probate. These are also very flexible instruments, allowing you to place conditions on gifts to protect your beneficiaries’ interests. In addition, with a trust in place, you are able to preserve and protect your assets from estate taxes.
Living Will
With a living will (also called an advance directive), you can declare what lifesaving procedures you would like to be taken — or withheld — depending on the circumstance. These include CPR, mechanical ventilation, defibrillation, or other types of care. In addition, your living will can state whether you choose to be an organ or tissue donor.
Power of Attorney
This option allows someone to transfer decision-making authority to another. The parties are called the principal and the agent, respectively. With a power of attorney in place, medical treatment, personal finances, or other purposes can be covered. The legal authority is transferable upon the creation of the power of attorney, or from a triggering event, such as the principal’s incapacity.
Parent Contingency Plan
If you die or become indefinitely incapacitated, what will happen to your minor children? With a parent contingency plan, you can express your preference regarding who should care for them in your absence. This is more urgent for single parents, although couples should consider the possibility that they both could be taken in a common accident.
These are only some of the many estate planning tools from which to choose. But what’s right for you depends on multiple circumstances, and there really is no one-size-fits-all plan. When you contact a West Valley Arizona lawyer from Pennington Law, PLLC, we’ll give you the expert advice and counsel you need for the best estate plan.
